1. Agreement to Terms

By accessing or using MindFlow AI mobile application ("the App"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the App. These terms apply to all users of the App, including without limitation users who are browsers, customers, and contributors of content.

2. Service Description

MindFlow AI is an AI-powered wellness and productivity tool that provides:

• Digital journaling capabilities for brain dumping and mental decluttering
• AI-powered insights and analysis of your journal entries
• Personalized recommendations for mental wellness and productivity
• Tools for prioritizing tasks and managing your mental state
• Wellness check-ins and mood tracking

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify us of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. Acceptable Use Policy

You agree NOT to use the App to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload or transmit viruses or malicious code
• Attempt to gain unauthorized access to the App or related systems
• Engage in any automated use of the system
• Impersonate or misrepresent your affiliation with any person or entity
• Share harmful, threatening, abusive, or harassing content

5. AI-Generated Insights

Important Disclaimer: MindFlow AI provides AI-generated insights based on your journal entries. You acknowledge and agree that:

• AI insights are for informational and self-reflection purposes only
• They do not constitute professional medical, psychological, or therapeutic advice
• You should consult qualified healthcare professionals for medical or mental health concerns
• MindFlow AI is not a substitute for professional mental health treatment
• We make no guarantees about the accuracy or effectiveness of AI-generated insights

6. Intellectual Property Rights

Our Content: The App and its original content (excluding your personal journal entries), features, and functionality are owned by MindFlow AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain all rights to your journal entries and personal content. By using the App, you grant us a limited license to process your content solely for providing the App's services to you.

7. Subscription and Payments

MindFlow AI may offer free and paid subscription plans:

• Free Tier: Basic journaling and limited AI insights
• Premium Tier: Advanced features, unlimited AI insights, and priority support
• Subscriptions are billed on a recurring basis (monthly or annually)
• Prices are subject to change with 30 days notice to existing subscribers
• Refunds are subject to our refund policy
• You can cancel your subscription at any time through the App settings

8. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or delete your account through the App settings.

9. Limitation of Liability

To the maximum extent permitted by law, MindFlow AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or inability to access the App
• Damages resulting from any conduct or content of third parties
• Unauthorized access, use, or alteration of your content

Our total liability shall not exceed the amount you paid us in the last 12 months, or $100, whichever is greater.

10. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's operation or the information, content, materials, or products included. You expressly agree that your use of the App is at your sole risk.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MindFlow AI operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
